coming - or give up his constitutional right to a trial and do a backstairs deal with the judge. In a scene of remarkable frankness, judge, prosecution and defence calmly trade off segments of Cecil Branch's life – life lost in Florida's crowded jails, and redeemed only by Florida's hard-pressed Parole Board.
Cecil Branch's case is unremarkable. To save the court's time, 90 per cent of Circuit Eleven cases are disposed of as his was. It is called 'plea bargaining' – an alarming process - for the incentives to plead guilty are often irresistible. Lest anyone should suppose that plea bargaining is an American aberration, English lawyer Walter Merricks reminds us that much the same pressures are put on defendants in this country.
