A citizen may be gravely damaged if a servant of the Crown fails to perform a public duty cast upon him - for example, if he fails to keep a dangerous prisoner in safe custody. Should the Crown be liable in damages to the injured citizen, or must the Crown and the servant be able to claim immunity, however careless the servant? Or should a balance be struck and how?
