Lady Wootton'. view is that in criminal eases one should think only about what is the best way to deal with people'; this is a much more adequate theory of punishment than that of meting out deserts She criticises recent legislation as half way between these two theories.
Professor Hart analyses the notions of responsibility implied in these theories and points out the difficulty of judging criminals rather than crimes. How do you measure responsibility? Can doctors do it better?
