In the last resort some theory of punishment lies behind the legal doctrine that a man is not guilty of a crime unless he had a guilty mind. In this talk Professor Hart considers the explanation of this doctrine offered by utilitarian and retributivist theories and the criticism of the great American judge 0. W.
