Constantin Brancusi is considered the father of modern sculpture. But 75 years ago, US Customs demanded 40 per cent duty on one of his sculptures, refusing to recognise it as a work of art (which would have been exempt from the tax), In the resulting trial, the court of law had to address that most elusive of questions - what is art?
